THE SPARKLE RANGE GLITTER – NEW LEGESLATION
RAINBOW DUST COLOURS: The Sparkle Range, Non-Toxic Glitter has passed and is compliant with the FSA’s new regulations. Have peace of mind when you use Rainbow Dust Colours Glitter!
As many of you will know, the legislation changed towards the end of 2011 regarding the labelling of Non-Toxic Glitters. The main concern from the Food Standards Agency (FSA) was that companies were either promoting the glitter as food, or that glitter was untested and being used around food.
(Rainbow Dust Colours have had test certification in place for food contact for about 3 years (we are only just into our 4th company year), however a re-test for migration was required as the regulations had been updated.)
At the end of 2011, the FSA stated that a any company selling Non-Toxic Glitters needed several key elements in place in order to continue sales within the cake decorating market. These are:
1. A test certificate to prove that the company supplying a “Food Contact” or “Non-Toxic” glitter has been tested for global migration limits to display that it does in fact live up to its name – caused no contamination to the food it is in contact with.
2. A declaration of compliance for “Articles In Contact with Food”. This is a document that is supplied to the local Trading Standards authority which identifies the materials contained within the glitter and that it is an identified and approved material.
3. Labelling requirements. It was deemed that “Non-Toxic – For Decoration use only” was not enough detail and some lesser companies were not even using any descriptive at all – some even promoted it as edible. They have now imposed the wording “Not to be Consumed” which Rainbow Dust Colours did immediately towards the end of 2011.(some companies are still dragging their feet on this point). A recent update has been made whereby we can use the phrase “Food Contact Use – Not to be Consumed” which we will be looking to introduce shortly.
The above is a very basic list and each point does require quite a lot of extra background work. We are very pleased to let you know that Rainbow Dust Colours has met every one of the above points and are one of the first companies to do so. We have satisfied Trading Standards and the FSA with all the details we have submitted, however we believe there are other glitter companies that have either failed testing or have not met the labelling requirements. As resellers of our products, and consumers making an informed purchase, these are the type companies you need to be cautious of. Alert your local trading standards should you see a false claim about Non-Toxic Glitter.
Labelling: All companies within cake decorating should adhere to the new legislation to include the words “Do not consume” – If it does not, they are breaking the law and could be prosecuted.
The phrase “Cake Glitter” – This is not allowed by Trading standards as it can cause confusion amongst consumers
Testing. If you suspect a company may not have tested their glitter or may not have a declaration of compliance, contact their local trading standards officer and request confirmation. If they do not, action needs to be taken.
